Eminent Domain ▪ Texas State Highway 130Perhaps the largest proposed highway project in Texas is planned to involve granting the government’s power of eminent domain to a private company, with limited direct oversight. This is billed as the Trans Texas Corridor Project. The project's stated goals create a series of interconnected highways, railways, and utility lines throughout Texas, including pathways roughly parallel to IH 35 and US 69, bypassing some communities. In order to complete this project, the condemnor reportedly plans to acquire property to fit a 1200-foot wide corridor. If completed, the project would change the face of travel in Texas. Some advocates have expressed concern that the land for construction of the Trans Texas Corridor and State Highway 130 is to be acquired by an entity that does not have direct accountability to the public, and has insufficient incentive to assure protection of rights of owners in the proposed pathway. Limited access and limited marketability of the remaining land of condemnee, whose properties are cut in two, are among the concerns on specific properties to be condemned. On a broader scale, uncertainty of the precise right of way path may leave owners in a form of “limbo”, unable to sell or build due to uncertainty of whether the property will be taken, and if so, when. At this time, there are simply too few clear answers. Until funding, alignment, and design issues have solidified, it is not possible to determine the impact upon affected property owners.
